OSTENDIO INC. PRIVACY POLICY

This Privacy Policy applies to www.ostendio.com (the “Site”) and the Ostendio software platform at www.myvcm.net (the “Services”), owned and operated by Ostendio, Inc. (“Ostendio”, “we”, “us”, or “our”). This Privacy Policy describes how Ostendio collects and uses the Personal Information (as defined below) you provide to us and it also describes the options available to you regarding our use of your Personal Information and how you can access and update this information.

When registering for Ostendio you can be certain that we have implemented a comprehensive security framework to ensure that only registered users and those people who are provided authorized access can see your Ostendio account information. We respect your right to privacy and feel it is important for you to know how we handle the information we receive from you via the Site and the Service.  The use of information collected through our services shall be limited to the purpose of providing the service for which the customer has engaged Ostendio.

1. INFORMATION YOU PROVIDE

When registering for the Service, you provide us with “Personal Information” such as your full name, company or organization name, and email address. “Personal Information” which refers to and includes your email address, billing address, IP address, and any other personal identifiable information which you submit or make accessible to us through the registration process at the Site and/or use of the Services. In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers.

When signing up for a paid plan, Ostendio may collect credit card information and use a third-party intermediary to manage credit card processing. This intermediary is not permitted to store, retain, or use your credit card or billing information except for the sole purpose of credit card processing on Ostendio’s behalf.

If your Personal Information changes, or if you no longer desire our Services, you can modify, update, delete your account information at any time by accessing your online account and clicking on the Settings icon in the navigation bar at the top right of the screen. Ostendio’s practice is not to use such Personal Information for marketing purposes unless explicitly authorized by you. Ostendio may use anonymized, aggregate information to measure the Services usage patterns and characteristics of its user base and otherwise to improve its products and services, and may include such anonymized, aggregate information about its audience in promotional materials or reports to third parties. This aggregate information will not reference any names, phone numbers, email addresses, or other personally identifiable information, and it will not be traceable to a specific recipient or user email address. As part of the Services, you may occasionally receive email, newsletters, and other communications from us. Administrative communications relating to your account (e.g., for purposes of account recovery or password reset) are considered part of the Services and your account, which you may not be able to opt-out from receiving. We also may send you other kinds of emails, which you can opt-out of either from your Account Settings page or by using the “Opt-Out” link in the emails themselves. Please note that we will never email you to ask for your password or other account information; if you receive such an email, please forward it to us. This Privacy Policy does not limit in any way our use or disclosure of aggregate information and we reserve the right to use and disclose any such aggregate information to our partners, customers, and other third parties at any time and in our discretion.

If we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to access and process your Personal Information as set forth in this Privacy Policy. If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices. We suggest that you check the Site periodically if you are concerned about how your information is used.

Ostendio will retain your information for as long as your account is active or as needed to provide Services to you. We will also retain personal data we process on behalf of our customers for as long as needed to provide services to our customers. Additionally, we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Ostendio may also transmit or share your Personal Information with its third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and other technology and services required to operate and maintain the Services, which may require that your Personal Information be transferred from your current location to the offices and servers of Ostendio and the authorized third parties referred to here. These companies are authorized to use your Personal Information only as necessary to provide their services to us. Although Ostendio owns the software, code, databases, and all rights to the Ostendio software application, you retain all rights to your data.

2. COOKIES

When visiting the Site or using the Services, we use session “cookies” – a piece of information stored on your computer – to allow the Site and/or Services to uniquely identify your browser while you are logged in and to enable Ostendio to process your online transactions. Session cookies also help us confirm your identity and are required in order to use the Services. Ostendio uses persistent cookies that only Ostendio can read and use to identify a user as an Ostendio customer and make it easier for you to log into the Services. Users who disable their web browsers’ ability to accept cookies will be able to browse our Site, but will not be able to access or take advantage of the Services. The use of cookies by our partners and service providers is not covered by this Privacy Policy. We do not have access or control over those cookies. Our partners and service providers may use session ID and persistent cookies to make it easier for you to navigate our site.

3. ANALYTICS / LOG FILES

As is true of most websites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site, and to gather demographic information about our user base as a whole. We do not link this automatically-collected data to Personal Information.

4. INFORMATION SHARING

Except as described in this Privacy Policy, Ostendio will not give, sell, trade, rent, distribute, or loan any Personal Information for marketing purposes to any third party. We may disclose such information to respond to subpoenas, court orders, regulatory requirements or governmental request, and/or any other type of legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, address security or technical concerns, situations involving potential threats to the physical safety or security of any person, violations or enforcement of our Terms of Service, protect against harm to the rights, property, or safety of our users or the public, or as otherwise required or permitted by law. Ostendio may also provide non-personal, summary or group statistics about our customers, sales, traffic patterns, and related Site information to reputable third-party vendors, but these statistics will not include any Personal Information.

5. CHILDREN’S PRIVACY

The Site and the Services are not directed to or intended for anyone under the age of 18. The Site does not knowingly collect or solicit information from anyone under the age of 18 or allow anyone under the age of 18 to sign up for the Services. In the event that we learn that we have gathered Personal Information from anyone under the age of 18, we will delete that information as soon as possible. 6. PROTECTION OF INFORMATION

We implement security measures designed to protect your Personal Information from unauthorized access. Your account is protected by your account password, and we urge you to take steps to keep your Personal Information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls, and secure socket layer technology (SSL). However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Accordingly, the security measures taken by Ostendio do not guarantee that your Personal Information will be protected against unauthorized access, disclosure, alteration, or destruction; nor does Ostendio represent or warrant that such information will not be accessed or used in an unauthorized manner or compromised. By using our Site and Services, you acknowledge that you understand and agree to assume these risks and, subject to applicable law, Ostendio will not be liable or responsible for any damages or expenses arising from or related to any breach of security.

7. LINKS TO THIRD-PARTY SITES

Our Site includes links to other websites whose privacy practices may differ from those of Ostendio. If you submit Personal Information to any of those third-party websites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

8. CORPORATE WEBSITE/BLOG

Our Site offers publicly accessible blogs and/or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your Personal Information from our blog and/or community forum, please email us at support@ostendio.com.  In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

9. EUROPEAN TERRITORY USERS

In compliance with certain privacy laws, in particular the European General Data Protection Regulation (GDPR) and other applicable privacy laws, we provide specific additional rights for individuals who interact with us such as the right to access, rectify, object, complain about, erasure, and blockage of your Personal Information. More specifically and under certain circumstances, you have the right to:
request information about whether and which Personal Data is processed by us, and the right to demand that Personal Data is rectified or amended; request that Personal Data should be deleted; demand that our processing of Personal Data should be restricted; withdraw your consent to the processing and use of your data completely or partially at any time with future application; obtain your Personal Data in a common, structured, and mechanically readable format; contact our data protection officer if there are any questions, comments, complaints or requests in connection with our statement on data protection and the processing of your Personal Data; and complain to the responsible supervisory authority or regulatory agency if you believe that our processing of your Personal Data is in violation of applicable law.

In addition to the above, we reference certain rights for European Territory citizens throughout this Privacy Policy. Pursuant to the GDPR, citizens from “European Territories” mean the European Economic Area (EEA), the European Free Trade Area (EFTA), and Switzerland. For the purpose of this Privacy Policy, the term “European Territories” shall continue to include the United Kingdom, even though the United Kingdom has left the European Economic Area following Brexit.

10. PRIVACY RIGHTS FOR CALIFORNIA RESIDENTS

This section applies only to California residents. It describes how we collect, use, and share Personal Information of California residents in operating our business and their rights with respect to that Personal Information. For purposes of this section, “Personal Information” has the meaning given in the California Consumer Privacy Act of 2018 (“CCPA”) but does not include information exempted from the scope of the CCPA.

As a California resident, you have the rights listed below. However, these rights are not absolute and in certain cases we may decline your request as permitted by law.

Information. You can request the following information about:
(i) how we have collected and used your Personal Information during the past 12 months;
(ii) the categories of Personal Information that we have collected;
(iii) the categories of sources from which we collected Personal Information;
(iv) the categories of third parties with whom we share Personal Information;
(v) whether we have disclosed your Personal Information for a business purpose and, if so, the categories of Personal Information received by each category of third-party recipient; and
(vi)whether we have sold your Personal Information and, if so, the categories of Personal Information received by each category of third-party recipient.
Access: You can request a copy of the Personal Information that we have collected about you during the past 12 months.
Deletion: You can ask us to delete the Personal Information that we have collected from you.
Opt-out of Sales: We do not sell your Personal Information that we have collected from you.
Opt-in: Since we do not sell your Personal Information to third-party recipients, there is no opt-in option to sell your Personal Information.
Non-Discrimination: You are entitled to exercise the rights described above free from discrimination. This means that we will not penalize you for exercising your rights by taking actions such as denying you services; increasing the price/rate of services; decreasing service quality; or suggesting that we may penalize you as described above for exercising your rights.

How to exercise your rights:
You may exercise your California privacy rights described above as follows:
Right to information, access and deletion: You can request to exercise your information, access, and deletion rights by emailing privacy@ostendio.com.
Right to opt-out or opt-in of the “sale” of your Personal Information: We do not sell, trade, or rent your Personal Information to third parties.
We will need to confirm your identity and California residency to process your requests to exercise your information, access, or deletion rights. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

11. PRIVACY RIGHTS FOR VIRGINIA, COLORADO, AND CONNECTICUT RESIDENTS

Under Virginia’s Consumer Data Protection Act (“CDPA”), Colorado’s Consumer Privacy Act (“CPA”), Connecticut’s Data Privacy Act (“CTDPA”), Virginia, Colorado, and Connecticut residents have certain rights regarding Ostendio’s collection, use, and sharing of their personal data. Ostendio does not sell your personal data and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law. Ostendio may engage in “targeted advertising” as that term is defined in the CDPA, CPA, and CTDPA. You have the right to opt-out of targeted advertising by contacting us at privacy@ostendio.com.]. Ostendio collects various categories of personal data when you use the Site and/or Services, including identifiers, commercial information, internet or other electronic network or device activity information, and professional information. A more detailed description of the information Ostendio collects and how we use it is described in this Privacy Policy. If you are a resident of Virginia, Colorado, or Connecticut, you have the right to: (1) request to know what personal data has been collected about you, and to access that information; (2) request to correct inaccuracies in your personal data; (3) request deletion of your personal data, though exceptions under the CDPA, CPA, CTDPA, and other laws may allow Ostendio to retain and use certain personal data notwithstanding your deletion request; and (4) obtain a copy of your personal data. 12. CHANGES TO PRIVACY POLICY

Ostendio may update this Privacy Policy from time to time. You can review the most current version of this Privacy Policy at any time at https://www.ostendio.com/privacy-policy. Your continued use of the Site and/or Services constitutes your agreement to be bound by such changes to the Privacy Policy. Your only remedy, if you do not accept the terms of this Privacy Policy, is to discontinue use of the Site and Services.

When you access and use the Services, you are subject and bound to the Ostendio Terms of Service located at https://www.ostendio.com/terms-of-use.
